Terms of Use

These Terms of Use govern your use of the Kids AI Q&A: Learning & Fun app (the "Application"), provided by Arun Prasath Breme (the "Service Provider"). By downloading, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, do not use the Application.

1. Use of the Application

• The Application is provided as a subscription-based service for personal, non-commercial use.
• You agree not to copy, modify, distribute, sell, or lease any part of the Application or its content.
• You must comply with all applicable laws and regulations while using the Application.

1a. Scope of License

This license is a non-transferable license to use the Application only on Apple-branded products that you own or control, including via Family Sharing, and in accordance with the Apple Media Services Terms and Conditions.

1b. Maintenance and Support

KidsQuest AI is solely responsible for providing any maintenance and support services with respect to the Application. Apple has no obligation to provide maintenance or support.

1c. Warranty and Refunds

If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation.

1d. Product Claims

KidsQuest AI, not Apple, is responsible for addressing any claims relating to the Application or your use of it, including product liability, regulatory compliance, and consumer protection claims.

1e. Intellectual Property Rights

In case of any third-party claim that the Application or your use of it infringes a third party’s IP rights, KidsQuest AI will be solely responsible for the investigation, defense, settlement, and discharge of such claims.

1f. Legal Compliance

You represent and warrant that (i) you are not located in a U.S.-embargoed country or designated as a prohibited or restricted party, and (ii) you will comply with all applicable export laws.

1h. Third‑Party Terms

You agree to comply with any third-party terms (e.g., wireless data service providers or App Store agreements) when using the Application.

1i. Third‑Party Beneficiary

You and KidsQuest AI agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them.

2. User Accounts & Data

• To use certain features, you may need to create an account and provide personal information (e.g., email, name, age).
• Your data will be handled as per our Privacy Policy.
• You are responsible for maintaining the security of your account. If you believe your account has been compromised, notify the Service Provider immediately.

3. Subscription, Billing & Payment

3.1 Subscription Plans

• The Application offers subscription-based access to premium features.
• Subscription plans may vary in duration (e.g., monthly, yearly) and pricing.

3.2 Payment & Renewal

• Payments are processed via Google Play Store or Apple App Store, depending on your device.
• Subscriptions automatically renew unless canceled at least 24 hours before renewal.
• You authorize the applicable app store to charge you according to the selected plan.

3.3 Cancellation & Refunds

• You can cancel anytime via your app store account settings.
• Once canceled, your subscription remains active until the end of the billing period; you won’t be charged for the next cycle.
• Refunds aren’t provided for partial periods, except as required by law or the app store’s refund policy.

4. Restrictions

• Do not use the Application for unlawful or malicious activities.
• Do not disrupt or overburden the Application.
• Do not reverse-engineer, decompile, or extract source code.

5. Intellectual Property

• The Application is owned by the Service Provider and protected by copyright and other IP laws.
• You receive a limited, non-exclusive license to use the Application for its intended purpose.

6. Third-Party Services

• The Application may use Google Play Services, Google Analytics for Firebase, Firebase Crashlytics, and other third-party services.
• KidsQuest AI is not responsible for the data practices of these third-party services.

7. Termination & Account Suspension

• KidsQuest AI may suspend or terminate access if you violate these Terms.
• No refund will be provided if your account is terminated for violations.
• You may delete your account at any time by contacting kidsaiconsole@gmail.com.

8. Disclaimer of Warranties

• The Application is provided “AS IS” without warranties, express or implied.
• No guarantee of error-free or uninterrupted operation or freedom from harmful components.

9. Limitation of Liability

• KidsQuest AI is not liable for direct, indirect, incidental, special, or consequential damages arising from use.
• Your sole remedy is to discontinue use of the Application.

10. Changes to These Terms

• KidsQuest AI may update these Terms at any time.
• Continued use after updates constitutes acceptance of the changes.

11. Governing Law

These Terms are governed by applicable laws without regard to conflict of laws principles.
